Divorce
We can start the divorce process for you and guide you through the process in a conciliatory and constructive way. We will advise you of the procedure involved from the outset and will keep you informed at each stage of the proceedings.
There is only one ground for divorce namely irretrievable breakdown, which is caused in one of five ways.
They are :-
- The Respondent has committed adultery and the petitioner finds it intolerable to live with the Respondent.
- The Respondent has behaved in such a way that the Petitioner cannot reasonably be expected to live with the Respondent.
- The Respondent has deserted the Petitioner for a continuous period of at least two years immediately preceding the presentation of this petition.
- The parties to the marriage have lived apart for a continuous period of at least two years immediately preceding the presentation of this petition and the Respondent consent to a decree being granted.
- The parties to the marriage have lived apart for a continuous period of at least five years immediately preceding the presentation of this petition.
The divorce itself will take approximately 4 to 6 months from the issue of the divorce petition to finalisation of the divorce, which is known as decree absolute.
